The National Misfuel Register — Your Claims Documentation

Misfuelled fuel is classified as a Class 3.1 flammable liquid — a hazardous substance. Under the Health and Safety at Work (Hazardous Substances) Regulations 2017, its disposal must be recorded. Every job handled by an NZIFDA-certified operator is filed on the National Misfuel Register, generating a Certificate of Compliance that documents what was disposed of, the method used, when and where the disposal occurred, and that manufacturer-specified procedures were followed.

This is the documentation insurers need for claims assessment. If the work was not done by a certified operator, there is no record on the register and no Certificate of Compliance.

Verifying Misfuel Claims

When assessing misfuel claims, verify:

  • Register record — was the disposal filed on the National Misfuel Register? Is there a Certificate of Compliance?
  • Method used — fuel pump access panel or full tank removal? If filler neck extraction was used, the claim should be scrutinised — no manufacturer prescribes this method
  • OEM alignment — does the method match the manufacturer's prescribed procedure for that vehicle?
  • Anti-siphon device integrity — were rollover valves and anti-siphon screens confirmed undamaged? Filler neck extraction damages these FMVSS 301 safety devices
  • Completeness of removal — was all contaminated fuel removed? Filler neck methods cannot reach fuel behind tank baffles
  • Parts replaced — fuel filter, seals, and gaskets renewed per manufacturer specification?

Repeat claim risk: Claims following filler neck extraction frequently generate secondary claims for injector, fuel pump, or catalytic converter damage caused by contaminated fuel that was not fully removed.

Approved vs Non-Approved Methods

✗ Not Certified — Filler Neck Extraction

Not prescribed by any manufacturer. Forces equipment past anti-siphon safety devices (FMVSS 301). Cannot achieve complete fuel removal. Generates repeat damage claims.

✓ NZIFDA Certified — OEM Methods

Fuel pump access panel removal or full tank removal per manufacturer service manual. Complete fuel removal. Documented on the register with Certificate of Compliance.

Risks of Non-Certified Operators

  • No register record — no Certificate of Compliance, no documentation of lawful disposal
  • Non-OEM methodology — filler neck extraction results in incomplete fuel removal and subsequent damage claims
  • Regulatory violations — mobile fuel removal often breaches Dangerous Goods, RMA, and EPA requirements, creating liability for insurers who authorise the work
  • Inadequate insurance — non-certified operators may not carry sufficient professional indemnity coverage ($2M+ required)
  • Repeat claims — incomplete remediation causes injector, pump, and catalytic converter damage presenting as secondary claims
  • Inflated costs — retail rates, fake charges (unnecessary pump replacements, inflated labour hours, phantom diagnostics), and vague invoices
  • No warranties — future failures result in additional claims with no recourse against the operator
  • Consumer Guarantees Act exposure — poor quality work breaches statutory guarantees, creating additional liability

Applicable Legislation

  • Health and Safety at Work (Hazardous Substances) Regulations 2017 — compulsory disposal record-keeping, met through filing on the National Misfuel Register
  • Consumer Guarantees Act 1993 — services must be performed with reasonable care and skill (s.28), fit for purpose (s.29)
  • Fair Trading Act 1986 — prohibits misleading conduct (s.9) and false representations about services (s.13)

All insurer applicants are subject to a vetting process to maintain the integrity of the network:

  1. Complete the application form with company information and claims volume estimates
  2. NZIFDA verifies company details, insurance licence, and regulatory standing
  3. Upon approval, receive access credentials and member resources
  4. Onboarding — training on the certified operator network, set rates, and member services
